The US Supreme Court at about 11:30 a.m. Friday issued its decision in Sackett v. EPA (you can access the full opinion at that link). As the opinion was published, Branan was heading into a webinar to outline the current rules (effective March 2023) interpreting the jurisdictional scope of the Clean Water Act, termed “Waters of the United States.” The Sackett opinion changes the legal basis for these rules by eliminating the “hydrologic nexus” test (championed by progressives), which relied on scientific analysis of the water quality impacts of manipulations to upland drainage. The Court has chosen the more literal continuous surface connection observation (championed by conservatives) as the law of the land. We are all uncertain of the reaction and timing of the current president’s administration in regards to interpreting the language of the decision for future rule-making and enforcement to come into line with this opinion.
